. This application is made by the subscriber requesting for allotment of space/ square meter or house unit(s) as mentioned above.
. Sabini Homes and Properties Limited reserves the right to allot the unit(s) requested by the subscriber .
. This application will be processed by Sabini Homes & Properties Limited only after the realization of the minimum initial deposit mentioned above in the payment details. All statutory fees as contained in the agreement as applicable from time to time shall be borne by the subscriber.
. By signing the form, the subscriber(s) affirm that they know the location of the project and 1 (are) satisfied with the same. The subscriber(s) also affirm that he/she/they have understood the scheme of investment/ development and are aware of the details of the project .
. Any default and/or withdraw on the part of the purchase at any stage of the subscription shall lead to forfeiture of the subscription and a refund of all sums paid less administrative charges and 30% of the total sum paid.
. If the subscriber(s) does not execute the sales agreement within a period of three months from the date of this application for the booking of the square meter(s) or unit(s), the Sabini Homes & Properties Limited shall at its option be entitled to cancel the unit. In this event, the subscriber(s) forfeit 30% of the amount paid for the unit(s), interest accured, and administrative charges, if any at the time of cancellation. The subscriber(s) shall be liable to pay all taxes, duties, and statutory levies of whatsoever nature. The taxes, duties, and statutory levies paid by the subscriber(s) cannot be refunded by Sabini Homes and Properties Limited.
. Upon such cancellation, Sabini Homes & Properties Limited is entiled to allot and sell the unit(s) to any other person on such terms and condition as Sabini Properties deems fit. Sabini Properties Limited shall pay the subscriber(s) the balance amount, within twelve(12) weeks from the date of sales of that unit or space without interest after the sale of the unit(s)/square meter.
. The subscriber(s) further agree that the allotment letter issued by Sabini Properties Limited is the provisional allotment letter and will be final only after the subscriber(s) execute the sales agreement.
. Notwithstanding the execution of the sales agreements, the subscriber(s) shall make the payment of the installments within the time limit ticked by the subscriber(s) in the subscription form. In case of any delay or default in making installment payments within 60 days, Sabini Properties Limited can at its best treat the transaction as terminated and will refund all sum paid less the 30% penalty fee after the resale of the space. Alternatively, Sabini Properties Limited may decide to charge interest of 5% per annum on the amount defaulted, in case the subscriber(s) is liable to pay.
. Third-party or proxy payment will not be allowed in case of refund.
. The subscriber(s) agrees that no rearrangement or transfer will be permitted without the prior approval of Sabini Properties Limited, except and until the title has been transferred by Sabini Properties Limited.
. Sabini Properties Limited can vary the price of the unsold units at its sole discretion and the same will not be applicable to this subscriber.
. All the communication sent by Sabini Properties Limited to the subscriber at the given address above shall be deemed to have been received by the subscriber either by email or by any form of communication mentioned above. Sabini Properties shall continue to correspond with the subscriber at the address is acknowledge by Sabini Properties. Any such communication sent by Sabini Properties Limited for whatever reason is deemed as received by the subscriber(s) agree(s) to abide by the content of such communication.
